Terms & Conditions
Last updated: August 30, 2025
These Terms & Conditions (“Terms”) govern your use of the Air Mogul website and services, including requests for quotes and the booking of private air charter services facilitated by Air Mogul (the “Broker”). By accessing our site or confirming a booking, you agree to these Terms.
1) Definitions
Client: the person or entity requesting a quote or booking. Passenger(s): persons travelling on the charter flight. Operator: licensed air carrier conducting the flight. Charter Contract: binding agreement including itinerary, aircraft type, price and Operator terms.
2) Scope of Services
Air Mogul sources aircraft, presents options and facilitates the contracting of flights with Operators. Air Mogul does not operate aircraft and does not provide air transportation; such services are provided solely by Operators under their own certificates, licenses and terms.
3) Quotes & Availability
- All quotes are non-binding, subject to aircraft availability, crew duty limits, airport slots, permits and weather.
- Times, routings and aircraft types are indicative until the Charter Contract is executed and funds are received as required.
- Costs may vary due to repositioning, de-icing, fuel surcharges, overnights, hangarage, extended ground time, airspace/ATC, war-risk or insurance premiums.
4) Booking Process
- Request: Client provides itinerary, dates, pax, baggage, pets and special needs.
- Options: Air Mogul shares aircraft options and indicative pricing.
- Charter Contract: Client signs the Operator’s (or Broker’s) Charter Contract and accepts all applicable terms.
- Payment: Deposit or full prepayment as stated. Booking is confirmed only upon receipt of cleared funds and contract execution.
- Itinerary: Final details, handling and FBO confirmed closer to departure; changes may affect price.
5) Prices, Taxes & Payments
- Currency: Unless stated otherwise, prices are in EUR and exclusive of applicable taxes/fees.
- Taxes/Fees: government/airport/FBO charges, catering above standard, ground transport and special services are additional unless expressly included.
- Payment methods: bank transfer, approved cards or other methods we communicate. Card fees/FX charges may apply. Funds must be received within the deadline specified.
- Security deposit: The Operator may require a hold/deposit for on-costs (e.g., de-icing, out-of-hours); any balance will be reconciled post-flight.
- Non-payment: If funds are not received on time, the aircraft may be released and the booking cancelled without liability to Air Mogul.
6) Changes, Delays & Cancellations
- Client changes: schedule/route/pax changes are subject to Operator approval, availability and additional costs.
- Crew duty & slots: Operational restrictions (duty time, slots, NOTAMs) may require schedule adjustments.
- Cancellations: The Charter Contract will set out the applicable cancellation terms (often tiered by days/hours before departure up to 100%). No-shows are treated as cancellations.
- Force majeure: Weather, ATC, security events, strikes, acts of government/war/terrorism or other events beyond control may cause delay/cancellation without liability.
- Refunds: Where due under the Charter Contract, refunds are processed net of unrecoverable costs and third-party fees.
7) Operations, Safety & Conduct
- Operational control rests exclusively with the Operator and pilot-in-command (PIC). The PIC may refuse carriage or alter routing for safety, legal or security reasons.
- Conduct: Passengers must comply with crew instructions and refrain from disruptive/illegal behaviour. Smoking/vaping may be prohibited by the Operator and local law.
- Security screening and baggage inspection may be required by law or the Operator.
- Dangerous goods are restricted under ICAO/IATA rules; declare special items in advance.
8) Documents, Visas & Customs
The Client is responsible for ensuring all Passengers possess valid travel documents (passports, visas, health paperwork) for all jurisdictions. Denied boarding for documentation issues will be treated in accordance with the Operator’s terms; related costs are borne by the Client.
9) Baggage, Special Items & Pets
- Limits depend on aircraft type/weight & balance. Oversize or excess items must be declared pre-booking.
- Special items: sports gear, musical instruments, medical equipment require prior approval.
- Pets: subject to aircraft, Operator policy and entry regulations; documentation and carriers may be required.
10) Aircraft Substitution
The Operator may substitute an equivalent or superior aircraft if necessary for operational reasons. If a material downgrade is proposed, the Client may be offered alternatives or applicable remedies as per the Charter Contract.
11) Liability & Disclaimers
- Air transportation is provided solely by Operators and is subject to their contractual terms and applicable conventions/laws.
- Broker liability: To the fullest extent permitted by law, Air Mogul shall not be liable for indirect, incidental, special or consequential losses (loss of profit, business or opportunity). Total liability, if any, shall not exceed the brokerage fee earned for the affected booking.
- Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
12) Indemnity
The Client agrees to indemnify and hold harmless Air Mogul from claims, losses, damages, penalties and expenses arising from (i) Client/Passenger breach of these Terms or the Charter Contract; (ii) inaccurate information provided; (iii) unlawful or unsafe conduct; (iv) customs/immigration violations attributable to the Client/Passengers.
